They probably don’t want to get into the issue of what happens when you start charging and nobody is around, then you go to do something and while you’re starting your meal at 92% or whatever someone jumps in the queue. You can say the policy is basically above 90% you must wait in your car ready to move it if someone joins the queue but that kind of rule complexity probably doesn’t improve that much vs the simple congestion rule they currently propose
