It was in his waistband, at the small of his back. You can see an agent lift his shirt and take the gun, then you hear the first shot. Agent with his gun runs away, other agents magdump on the man.

Latest angles show the gun had been removed and the other agent had enough time to see. Also the suspect was face down on the ground before he was shot in the back.

There are a lot of videos. I think the guy that initially pepper sprayed him and another protester is the one that also shoots him 4 times in the back. Then I think another couple of shots came from others afterwards.
They shoved a protester to the ground. The guy tries to help them up and is repeatedly pepper sprayed along with the other protester. They then gang on him while he continues to try and help the protester. They then have him on his knees, another one hits him repeatedly in the head with their pepper spray can when the initial guy puts up his pepper spray can and pulls out his gun and shoots him in the back.

Homeland Security shares account of fatal shooting The Department of Homeland Security said federal agents were conducting a “targeted operation” in Minneapolis at 9:05 a.m. Saturday looking for “an illegal alien wanted for violent assault.”
“An individual approached U.S. Border Patrol officers with a 9 mm semi-automatic handgun,” the agency said in a statement. “The officers attempted to disarm the suspect but the armed suspect violently resisted.”
“Fearing for his life and the lives and safety of fellow officers, an agent fired defensive shots,” the department’s statement continued. “Medics on scene immediately delivered medical aid to the subject but was pronounced dead at the scene.”
DHS said the man had two magazines and “no ID” and that more information would be coming.

It would be a coup at that point. The national guard is commanded by the Governor of the state, but the President can also legally override the governor and take control.
